TERMS & CONDITIONS
Within the heading of terms & conditions Room-by-Room (UK) Ltd may be referred to as "Room-by-Room", "Room-by-Room (UK) Ltd", "the Company", "the firm", "our", "us" or "we".

Under the heading of TERMS & CONDITIONS we may refer to the customer(s) as the "client(s)", "he", "she", "you", "your", "Customer(s)", "Property Owner(s)".

 

Advertising Boards and Hoardings
The customer agrees to us installing an advertising board in a prominent location from the date of instructing us to carry out the survey until 8 weeks after the building works are completed. The advertising board will remain the firms property but it is the customers duty to inform the firm of any repairs or maintenance that may need to ensure the board is safe and secure. If the board is lost or stolen the cost of providing new boards or hordings will be £150 each payable by the customer within 7 days of the notice or notification date. If the board causes damage to the owners property we can not be held responsible.

 

Costs
How we calculate your bill.
This firm operates three cost types. The "Time Cost" for project management and site supervision, a "Fixed Price Cost" for individual design elements, design & build and building work and an "Estimates Cost" where either no drawings or only preliminary drawings have been produced.

The firms "Time Cost" measures the amount of time spent in connection with your project.   To calculate the amounts due we keep a record of how much time is spent in attendances upon you or others on your behalf.  A record is also kept of all letters written, received and telephone calls.  All time spent in the perusal or preparation of documents will be recorded and charged accordingly.  If letters are prepared that are lengthy in their nature we may charge you for the time taken to prepare that letter as opposed to a simple charge for the letter, as detailed below.

The firms "Fixed Price Cost" will be provided to the customer in the following fromat. A written document which will clearly state "Fixed Price Cost" underlined and with a description of the work included and the price. We may refer back to the approved drawings within the detail of the Fixed Price Cost for the general positioning and location of a product or material. When no details appear on the approved drawing(s) regarding the specification of a product or material and or we have not provided a provisional sum or financial amount for the item or items we reserve the right to recalculate this cost or charge an extra for the product and its installation as we see fit or necessary.

The firms "Estimated Cost" for a project is based on what can be seen at the time of the first visit or at the time of carrying out the measured survey. Where the firm provides an estimated cost to a customer it will be for the cost of the building work only and will not include professional charges or fees associated with the design of the project. Additionally, we would recommend to a customer that building work is not an exact science and therefore the estimated cost we provide may change according to site conditions and structural elements which are not visible during the design stage. Customers should have a contingency budget for additional costs of between 18% and 23% for such unforseeable issues during the building process. The firms "Estimated Cost" is a nett figure and therefore may be subject to the addition of VAT at the current rate.

The firm reviews its charging rates annually, in January, and we will inform you as to any change in the rates to be charged at that time.

After calculating the time spent, (which is costed in six minute units) a total figure is produced.  This figure will, of course, may be subject to VAT, which will be added as necessary.  In addition you will also be charged for any disbursements which the firm has incurred in dealing with your matter, for example planning fees, building control fees, site plan fees, soil reports.  Your approval to incur such fees will be obtained in advance.

 

Interest on bills
In the event that payment of a bill is not made we reserve the right to charge interest at 1.5% per annum over the base lending rate of Barclays Bank plc on the outstanding amount.  Such will be added if a bill remains unpaid for over one month. In the case of late payment, we reserve the right to recover from the debtor any costs incured in collecting the debt.

 

Outstanding Bills
Additionally, if a bill remains unpaid for one month from the date upon which it was rendered then we will terminate work until the payment is received. We reserve the right to recover from the debtor any costs incured in collecting the debt. We also reserve the right to seize any of the customers goods when payment is not made.

 

Initial Meetings
Initial meeting appointment charges are shown above although this charge may be reduced or removed at the discretion of the directors only. When a customer wishes to cancel an initial meeting appointment this must be in writing as an e-mail or a text message is acceptable. We must have received the customers cancellation in good time of the meeting but within not less than 24 hours of the time of the meeting. When no such notice period is provided we reserve the right to charge for the time taken to travel to the customers property and an additional one hour of our time at the full initial meeting charge shown above.

 

Preliminary Design

Where an estimated building cost is not accurate enough the firm may offer to produce a preliminary drawing at a fixed fee. This may provide basic structure information and enough design detail to enable us to quantify the work needed to construct the proposed building work and to more accurately calculate the estimated cost subject to caviats and or unknown information such as existing stucture, soil conditions, existing foundations etc. We will require from you copies of the original building approved drawings or where these are not available we may need to carry out exploratory works to establish this information. Our quote for the production of preliminary drawings does not include text or email messages sent or received or our time out of the office researching your properties history or consulting with other professionals such as M&E consultants, structural engineers, planning officers etc and these will be chargeable at the rates shown above and or on a time cost fee.

Sketch Drawings
Sketch drawings are produced for all work to be priced. Existing and proposed drawings are issue to the client for checking prior to the work on the pricing commencing. A fee proposal will be issued to the customer prior to any work commencing. The fee for the production of the drawings must be paid on the survey date. Minor altertaions to the drawings are included in the fee to a maximum time period of 30 minutes, any altertaions requiring longer to complete is chargable at the hourly rate of either £175 for residential work or £280 for commercial work.
 

Planning Drawings

In order to comply with the local authority planning requirements these planning drawings must contain existing and proposed drawings with appropriate scales, site and block plans with north point and scales, a title block with applicants name, address, site address if different, drawing number, date drawn, revisions and the details of the proposed work. When planning drawings are presented to the customer we reserve the right to only provide the existing and proposed plans and elevations. At this stage of the design process we will provide the customer with our invoice for the production of the drawings which must be paid in full prior to changes or alterations being made to the drawings or the drawings being submitted to the planning department.

Completed drawings which are ready to be submitted to the planning authority will only be provided when the full payment for the production of the drawings detailed on the payment schedule part of our written quote letter to the customer has been received. No alterations, revisions and or changes requested will be carried out until the payment is received.

 

Building Control Drawings
As acting agents we will decide which Building Control organisation to engage to check and approve the drawings and or inspect the building works during construction.

Unless detailed within our written quote we will decide the materials to be used for the construction of the proposed building work. If we are asked to change the building control drawings and detail alternative methods of construction or materials for construction we must receive the full payment for the production of the building drawing we have produced first as detailed in the written quote. We will then provide the customer with a new quote for this new drawing.

When we are providing a Design and Build Service we will detail within the brief the inclussion of the costs for producing structural designs and calculations. If this is not shown as included within our quote this will be chargeable as an extra cost. 

 

Copyright
When architectural drawings are produced for a customer the drawings remain the copyright of Room-by-Room (UK) Ltd until released via either a licence agreement for a time period for a specific single purpose or with the written approval on headed paper and signature of the director. Unauthorisde revision, modification, alteration, partial or full use of the drawings by a customer will be seen as a breach of copyright. Where copyright is breached in the way discribed the maximum cost for each breach will be £20,000. 

 

SAP
The current standard term used for calculating heat loss from a building using u-values of individual elements to establish a final quantity. In order to carry out a SAP calculation a full property survey must be completed. 

 

Party Wall Act 1996
It is the responsibility of the customer to ensure that the party wall agreement is in place prior to any building work starting on site. Delays due to party wall disputes will be charged to the customer if building works are not permitted or unable to continue or commence while the dispute is resolved at our standard hourly rate per person unable to carry out their duties and based on a day of not more than eight hours.

 

Photographic Survey
After completing the measured survey we will carry out a photographic survey. We will take photographs of the inside of the property including the loft space and or cellar as we see necessary as well as external photographs of the walls and surrounding trees, waterways etc within a distance of 100M from the property. By allowing us to carry out the photographic survey the customer agrees to allow us to upload the photographs of the property to our website and or include the photographs within our leaflets for distribution as we see fit. We retain the copywrite for these images unless bought and paid for by the customer for no less than £150 per image.

 

Measured Survey
In order to produce a scale drawing of your property it will be necessary for a measured survey to be completed. Measurements will normally be taken from within the building and may also be taken from outside. More complex structures like churches may require several visits in order for the drawings to be produced.

 

Payment Schedule
This companies Fixed Price Quote will provide a detailed schedule for payments. Payments will be staggered in accordance with the stage that the project has reached or is about to reach.

A payment schedule for projects undertaken on a Time Cost basis will be detailed on the quote to the customer.

Where the payment schedule states "On the day of the survey" This payment must be received by us on this day of the survey.

Where the payment schedule states "On production of planning drawings" this payment must be received by us within 7 days in order to prevent additional charges for late payment being added.

Where the payment schedule states "On production of building drawings" this payment must be received by us within 7 days in order to prevent additioanl charges for late payment being added.

 

Design & Build Contracts
In order for a Deign and Build Contract to commence we will provide a letter printed on the company headed paper and with the heading "Design & Build" just below the full name of the company name at the top. The property owner and or the customer must provided their signatures on each page of the letter as must a director of the company. The design stage payment usually of 10% of the overall value of the estimate or quote is non refundable after the planning drawing has been produced. The design stage payment must be paid in full at the time of signing the estimate or quote without exception. the customer at the time of signing the letter of instruction and The design stage will commence once the payment is received and cleared by the bank.
Once the payment has been authorised we will carry out the measured survey of the property. Our letter or contract will confirm the scope of the works and we will indicate on the estimate or quote where the terms and conditions can be found on the website. This deposit will cover the cost of the measured survey, producing the existing and proposed architectural drawings, the structural engineers' fees, the planning and building control fees and provision for a maximum of two meetings with the customer from the date of the measured survey to the agreed start date for the construction to begin and a maximum of two e-mails from the customer to ourselves.
Any revisions requested by the customer once the drawings have been issued to the structural engineer for design and calculations will be charged back to the customer without written notice or approval.
Production of the planning and building control drawings is no guarantee that the proposed development will be granted approval either by the local authority or other regulatory organisation. Therefore, if the proposed drawings can not or will not be approved by the local authority under their original planning reference number then additional costs for alterations to these drawings will be charged at our standard hourly rate of £65 which can also be is costed in six minute units. Where the inspecting building control officer requests alterations or additional methods to be included during the construction these costs will be charged to the customer as extras.

Any work requested by the customer which is not first discussed with the firm during the construction period and is paid directly to our sub contractor or their own employees may terminate our contract. For example if the customer asks the firms electrician to install extra sockets without our prior knowledgs or agreement as an approved extra the firm may terminate the contract with the customer without notice. all work up to that point plus an extra 25% of the remaining value of the contract or £5000 which ever is the greater must be paid within 7days from the contract termination date. Direct or indirect payments to our tradesmen, contractors or sub contractors under any circumstances. Our price for the design and build contract does not include text or email messages sent or received or our time out of the office researching your properties history or consulting with other professionals such as M&E consultants, structural engineers, planning officers etc and these will be chargeable at the rates shown above, unless otherwise stated in our signed contract.

Design Contracts
When one or more of these elements or parts is not carried out as described above the project will be treated as a Design Contract. All elements or parts of the project designated as parts of the design stage will therefore be paid individually by the customer and not as a collective lump sum. The initial fee paid will cover the cost of the measured survey and producing drawings for the architectural design element of the proposed work only. This fee will not form any part of any other element required in order to comply with either planning or building control or any other part that may be associated with a design and build project. This first payment is non refundable once the survey has been carried out. After the survey is completed a period of 15 working days may be taken in order to produce a preliminary drawing for the customer and payment must be made for this drawing in full prior to any additional work to change or alter the drawing. The structural design of the proposed works may take ten weeks to complete depending upon the complexity of the project and the design issues associated with it. The appointed structural engineer will contact the customer with their fee proposal and upon written instruction to the structural engineer for the agreed fee the engineer will commence with the structural design and calculations. Once the design is complete we will contact the customer in order to arrange the payment for the appropriate fee for planning and or building control as required. Once the plans are approved as acting agent for the customer we will price the work based upon the approved drawings to establish a more accurate estimate for the construction cost. Clearly, as we are not providing a Design and Build service the customer has no tie to us and would be within their rights to contact other building contractors for prices and therefore engage these other builders to carry out the building work on their behalf.

If the customer decides not to use Room-by-Room (UK) Ltd for the construction of the approved drawings outside of the terms of the Design and Build Contract, Room-by-Room (UK) Ltd will not and can not be held responsible or liable for the information, details or design detailed on these drawings. The liability for the information on these drawings is the sole responsibility of the customer. The customer may engage Room-by-Room (UK) Ltd on a consultancy basis to oversee the building work or to project manage the building process but this would need to be detailed in a new contract.

The individual parts of the Design Stages or Design Elements are the architectural design, the ordinance survey map, the structural design and calculations, the plumbing and heating design, the electrical layout design, the planning application forms and fee, the building control application forms and fee and the building control inspection forms and fee. Our price for the design contract does not include text or email messages sent or received or our time out of the office researching your properties history or consulting with other professionals such as M&E consultants, structural engineers, planning officers etc and these will be chargeable at the rates shown above, unless otherwise stated in our signed contract.
Where drawings are issued and approved by the client either verbally or in writting the payment for these drawings must be received prior to the next stage of the design process commencing. Invoices are to be paid within a maximum period of 7 working days from the date of issue. The company remains the owner of all design drawings under copyright. Drawings may not be used in part or fully without a written licence issued by the company. If drawings are used by the client as part of a submission for any purpose either fully, partially or in a modified form, without receiving a licence from the company, the company reserves the right to charge a minimum fee of £199 for each individual drawing used under breach of copyright. The fee for this unauthorised use will not form a licenece for continued or future use. The drawings or written materials owned by the comapny must be removed prior to applying for a licence to use the drawings or materials. If the fee for unauthoriesed use is not received within 14 days the mater, Interest on Bills and Outstanding Bills will apply. 

 

Preliminary Drawing(s)
We may provide a preliminary drawing for the purpose of producing a better estimate. A reduced design fee may be offered for this sevice but these preliminary drawings will need to be enhanced, at an extra cost, in order for them to be submitted for planning or building control approval. We may indicate the positions of structural elements but these are of course subject to our structural engineer agreeing and approving their sizes and locations prior to submission for approval. Only when drawings have been produced will we have a clearer understanding of the building work required to construct the proposed alterations to your property.

 

Snagging
What is "snagging"?
Snagging is phrase used in the building industry to identify a defect and a solution. Thirty days after the completion certificate has been awarded by the building control officer we will revisit your extension and correct defects.

 

Retention of money
For projects with a total value of less than £100,000 no retention will occur.
For projects with a total value greater than £100,001 retention will be 1.2% of the total cost.

 

WARRANTY AND LIMITATION OF LIABILITY
Act of god, explosion, flood, tempest, fire or accident
Acts, restrictions, regulations, bye-laws, prohibition, or measures of any kind on the part of any government, parliamentary or local authority;
Import or export regulations or embargoes;
Strikes lock outs or other industrial actions or trade disputes( whether involving employees of the Company or a third party);
Difficulties in obtaining raw materials, labour, fuel, parts or machinery;
Where circumstances for the supply of products or materials are beyond our control we can not be held responsible for their out come. When water shortages and or hose pipe bans are imposed while building your extension this may prevent us from clearing up the site as well as we would like and therefore we may not be held responsible for damage caused to your property where or when this takes place.

DISCLAIMER
Before commencement of the Services, the company shall inform (if not already informed on the quote and or contract) the Customer of any works to the property which could result in damage to the property or items in the property, which the Company will not be liable for (including but not limited to the items referred to under the heading warranties and limited liabilities.
once the customer has been informed and signed a form of consent either the quote and or contract document for the company to proceed with providing goods and or services the Company shall not be liable for replacing and or making good any items or areas within the boundary of the property through the provision of the goods and or services in connection with any of the items referred to in under the above heading of Disclaimer.
Where the Company agrees to repair or make good any damage to the property resulting the performance of its services, the Company reserves the right to determine whether adequate cleaning of the Property is sufficient to repair any damage so covered.

 

Termination of our contract by Room-by-Room (UK) Ltd
Where our sub contractors are instructed directly by the customer, paid directly by the customer or asked to carry out additional work which is not part of our quote by the customer we reserve the right to terminate our contract and remove any rights the customer may have in relation to the guarantee or warranty that we provide for our building work or services. When we terminate our we will send you a letter on headed paper confirming our termination and we may state the reasons for the termination. Any outstanding work which we have not completed or snagging issues which you have now or may arise later will no longer be our responsibility to complete or repair or fix or maintain. Any outstanding money which you still hold must be paid to us in full within 7 days from the date of our contract termination, together with any additional money which we can show is a legitimate fee or charge either based upon the information detailed within these terms and conditions and or forms part of our original agreement.

 

Termination of our contract by the customer
Where you terminate our contract either verbally or in writing we will confirm your instruction to us either via e-mail or as a letter within 14 days. We will inform the local authority building control of your decision and advise them the position that the building work was at on the last day that we attended your property. Any work that we ourselves have completed at your property will not be guaranteed nor will any further work be guaranteed by us which may have been carried out by you or companies or individuals that you instruct to complete the job after our contract termination. Any tools, hired equipment, skip hire and or materials which are at your property or have been used in the construction of your extension at your property must be paid for by you in full no mater how much money is left to pay on our staged payments. Any materials that have been delivered to your property and have not been paid for through our staged payment plan at the time of the contract termination must be paid for by you within 14 days of our termination letter arriving at your property. Materials delivered to your property will remain the property of Room-by-Room (UK) Ltd until they have been fully paid for by you. Where these materials have already been used on your building work they must be paid for within 28 days of delivery to your property. We reserve the right to charge interest of 5% per month for non payment of these goods and materials or part there of on a daily basis.

 

 

CONSTRUCTION

Foundation Shuttering
Foundation shuttering is not included within our estimates or quotes. Therefore, where the ground conditions require us to provide shuttering inside the foundation trench, the materials supplied and installed by us to support the sides of the trenches will be charged back to the customer at a cost of £150 per linear meter of trench supported in this way. This charge will cover the costs for the additional materials and labour.

Damaged Pipes & Cables
During the removal of the over site and or the formation of the foundation trenches any pipes which are buried under ground and that are therefore not visible or indicated on any drawings which burst or become broken or damaged during this work will be fixed or repaired at the additional expense of the customer. Delays to the work on site due to these unforeseen circumstances must be financially met by the customer. Room-by-Room (UK) Ltd will not accept responsibility for any liability relating to this matter. Any costs incurred by us for a specialist service providers such as plumbers or electricians called out by us at short notice must be paid for in full by you. The cost of this type of emergency call out will be as detailed above £120 per person attending plus an additional cost of £60 per hour for each person in attendance plus the costs of any parts on each occasion and for each service provider or tradesman called out.

Extra Plumbing Costs
During the construction of your extension it may be necessary for us to call out our approved Gas Safe and OFTEC heating and plumbing engineers to safely remove, relocate, and or divert supplies in order for the work on your extension to continue safely and without delay. No provision for this will be made within our quote and therefore only when this is absolutely necessary will we instruct our engineer to attend your property and resolve the problem. The extra cost for this type of emergency call out will be a fixed fee of £250 labour plus parts on each occasion and for each service provider or tradesman called out.

Extra Electrical Costs
During the construction of your extension it may be necessary for us to call out our approved NICEIC electrical engineers to safely remove, relocate, and or divert electricity supplies in order for the work on your extension to continue without too long a delay. The extra cost for this type of call out will be a fixed fee of £250 labour plus parts on each occasion and for each service provider or tradesman called out. No provision for this will be made within our quote to you and therefore only when this is absolutely necessary and our engineer resolves a problem such as this these extra costs for this additional work must be paid in full by you. Within our quote we will indicate the quantity and type of fitting included but if you decide that the quantity of electrical goods such as sockets, switches, spot lights, pendant lights etc is insufficient then we will provide these additions to your new specification at an additional cost per item. Please refer to your guarantee under our terms & conditions to ensure you understand our policy for adding extra electrics during the time we are employed as your contractor. If you instruct our electrician or your own to install extra items without our knowledge or written approval we may terminate the contract or agreement with you without penalty and any warrantee or guarantee we may have offered will be void and or terminated as well.

Materials
Materials delivered to your property will remain the property of Room-by-Room (UK) Ltd until they have been fully paid for by you. Where these materials have already been used on your building work they must be paid for within 14 days of delivery to your property. We reserve the right to charge interest of 5% per month for non payment of these goods and materials or part there of on a daily basis.

Materials Damaged or Stolen
Materials which we order and have delivered to your property will be your responsibility until they are either installed, used or returned to the supplier. Any materials which are damaged and or stolen while on your property must be paid for in full by you without exception. These costs will be extra and above the overall agreed building work cost.

Not building to the approved drawings
Room-by-Room (UK) Ltd can not and will not be held accountable to local government, local authority or other organisations for changes made to the size, height, style or colour of a building when the customer instructs the firm to do so. When the customer instructs the firm to increase the size of the footprint of the building, thereby making the floor area larger in any part or all of the extension, than the approved drawings, we will assume that you have already gained the necessary appovals for this work to be carried out. Therefore, it is the customers responsibility to inform the local authority planning office of this change and gain the appropriate approvals.

As Built Drawings
When you instruct us verbally or in writing to make changes to the shape, style, height, size or appearance of the actual building during construction, these alterations must be shown and detailed on a new as built drawing which may be needed in order to gaining the Local Authority Building Control Certificate of Completion. We will produce an as built drawing at the end of the construction process or after our contract is terminated by either us or by you. The cost for creating this new as built drawing will be charged at 10% of the actual construction cost including any extra costs which you paid to us or other companies or organisations that carried out work during the construction of your extension. Your local authority approved planning & building control will need copies of the as built drawings if you have significantly altered the footprint of the extension beyond that of the originally approved drawings. The as built drawings must be produced and given to the local authority building control inspector in order for the completion certificate to be issued at the end of the construction process. If you have the as built drawings produced by another company we reserve the right to withdraw our Guarantee and or warranty for all of the design and building works and we may take action to recover our losses for this work.
Room-by-Room(UK) Ltd nor our employees or sub contractors may be held liable, accountable and or responsible for any action taken by a government body, local authority in regarding to matters related to these alterations which do not tie up with the approved documents. We will not accept any liability, accountability or responsibility financial or otherwise for taking down or modifying the as built construction of your extension where planning enforcement prosecute you for building or altering the look of your extension without receiving the approval from the local authority first. Any company acting on your behalf seeking damages or costs relating to this work that you yourself have verbally or in writing instructed us to carry out during the construction of your extension and or any such alteration not previously confirmed in writing or approved by the appropriate department of the local authority will remain your own responsibility only.

Bio-Diversity
When work to connect to or materially alter or open up an existing pitched or flat roof within an area which may be considered to be within a designated zone of or within the remit of a local authority bio-diversity document it is the responsibility of the customer to ensure that the appropriate certificate or written letter of approval is received prior to any work commencing on that roof and the extension or conversion.
Where we discover any signs of bats or newts or sloe worms or snakes within the scope of our building works which we believe to be a protected species we will inform the appropriate government body immediately as these animals are protected under UK law. All work on your extension will then cease until such time as the authority to commence is received from an appropriate agency or organisation. We reserve the right to receive additional payments from you on our standard day rate of £500 for as long as is necessary for the protected animals to be safely relocated or moved. When these payments reach a total amount of £5,000 and this issue does not look to be resolved soon after this amount has been reached we will reduce our day rate for this to £350 and we may either resume construction of your works on a given date within no longer than an additional 8 weeks or terminate our contract with you after this 8 week time scale has been passed.

Items named but with no details or specification within our quote
1. Where we have indicated on the front of our quote a patio which has no specification or details relating to its construction or final finish design within the pages of our contract / quote we reserve not to provide this as we have not included this in our quoted price. Where the patio is stated or mentioned but not specified or detailed as to its construction or material finish we reserve the right to determine the quality of materials to be used, style, colour, look and design. The maximum overall size of the patio area will be no greater than 3M x 3M to a total size of 9 meters square. Steps do not and will not form any part of the patio and these will need to be designed, quoted and constructed on a separate cost from us. Where no patio specification is detailed on the approved drawings but is detailed as an item under the heading of new works the specification for the patio will be as follows: we will provide a single layer of geo-textile material laid directly onto the ground in the area designated as the patio to a maximum size of 9meters square with 5mm pea shingle applied directly on top to a depth of not more than 10mm based upon average coverage.

2. Where the drawing indicates internal doors but they are not specified in design, style or stated that they are to match the existing we will make a provision for and a provide within our quoted cost a standard 6 panel moulded door at a typical price of not greater than £15 per door. These doors will be hung by us on our own hinges that we will supplied. Handles, latches and locks will be supplied by the customer and fitted by us at an extra cost of £70 per door.

3. Where we indicate that painting will be carried out by us the following applies. The paint will be supplied at the customers own expense unless agreed within the quote and noted on the approved planning and building control drawings. We will apply one full coat of your chosen paint to walls, ceilings, doors architraves and skirting only where and as detailed on the planning and building control approved drawings or detailed within our own quote. Where additional painting is necessary or requested by you we charge this work on a day rate fee of £200 per painter.

4. Retaining walls which are not classified as structural elements and therefore are not overseen by the local authority building control inspecting officer and do not have a specification for the construction will be constructed as 300mm wide cavity walls formed from min. 7N concrete blocks with steel bars placed vertically within the cavity at approximately 1.2M maximum closed centres. The cavity will then be fully filled with a strong concrete mix. Two coats of liquid DPM tanking will be applied to the garden side of the wall and the facing side will be either rendered or painted with paint supplied by you. The top of the wall will be finished with 2 coats of liquid DPM tanking. Any variations that you want other than that stated above will be charged at an extra cost.

Construction Guarantee
We will provide a guarantee for the materials supplied & quality of workmanship for the stated period of time as detailed within our fixed price quote and or building contract where all of the following parts are strictly adhered to by you without exception.

1. Any extra or additional work outside the terms of our agreed quote that you request must be agreed with us, costed by us and work undertaken/carried out and completed by us or our own sub contractors and paid for directly to us without exception in order for the guarantee to be activated. When you instruct any additional work to be carried out or complete by our own sub contractors or other contractors or sub contractors who are or are not verified by us to carry out work and you do this without our involvement and or knowledge and or written approval and we do not oversee the work that these individuals or companies carried out this will invalidate your guarantee and the offer of our guarantee will be terminated.
In the event that you want our guarantee at the end of the construction to remain in place and valid after this work has already been carried out we will arrange for our own tradesmen to verify that these alterations have been completed correctly and with an additional payment for each extra change we may permit the guarantee to be activated.

 

MAINTAINANCE AGREEMENT
Where we have provided you with a 10 year guarantee for your extension you must agree to our maintenance agreement for the same period of time in order for our guarantee for the work we have carried out to remain active. If you decide to opt out of our maintenance agreement our guarantee for the whole of your extension also finishes.

We will contact you on an annual basis at the same time of the year in order to organise the servicing of your boiler to ensure that it is working correctly and at optimum efficiency. We will also complete structural checks around the extension to ensure that our building work has no significant problems or faults. In order for the servicing and checks to be carried out and for the administration of the maintenance contract we will charge you an annual fee of £125 plus VAT where appropriate. For labour and additional costs for parts as needed in order to service your boiler

At the time that the terms and conditions were written Room-by-Room (UK) Ltd did not have to charge VAT, however in the future VAT may need to be charged on top of the prices quoted.
